Customers experiencing antisocial behaviour (ASB) are increasingly capturing evidence on their mobile devices or domestic CCTV including door-bell cameras. The ASB evidence form allows customers to send files to us securely. During our ASB investigation we require to seek corroboration from all sources including audio and video recordings. This allows us to take the most appropriate action with regards to the report of ASB.

Wheatley Homes Glasgow will be the 'data controllers' of the personal information that you provide to us when you complete the ASB Evidence form. This information is required to process the digital file which you attach to the form.

Wheatley Homes Glasgow forms part of Wheatley Group. The Registered Social Landlords within Wheatley Group include Wheatley Homes East, Loretto Housing and Wheatley Homes South.

What personal information we will collect 

The information we require from you when you complete the ASB Evidence form is as follows:

  • Name
  • Address
  • E-mail address
  • Contact telephone number
  • Details of incident

How we intend to use your personal information 

We will process your personal information in accordance with Wheatley Homes Glasgow Articles of Association to fulfil our public task to investigate reports of anti-social behaviour as required by the Anti-Social Behaviour (Scotland) Act 2004.

Who we share your personal information with

We may share your information with partner agencies as part of our investigation into your reports of anti-social behaviour:

  • Police Scotland
  • Health & Social Care Partnerships
  • Scottish Court Service
  • Legal advisors

We will only share information in accordance with UK data protection legislation.

We may transfer information about you to other Wheatley Group companies for purposes connected to the management of the company’s business.

How long will you keep my personal information? 

If we review your digital file and decide that it contains evidence of anti-social behaviour we will upload the file to our anti-social behaviour case management platform Safer Communities.  Information on Safer Communities is retained for a period of 5 years following the closure of the case.

Digital files which are not assessed as containing evidence will be retained on Sharepoint for 1 year before being deleted.

Where will my personal information be kept? 

Your personal information is stored on our IT systems which may be copied for testing, backup, archiving and disaster recovery purposes. Access to your information is limited to those who require it to provide services to you. All data is held within the European Union (EU).

If any of your personal information is transferred out with the European Union or the European Economic Area by any of our contractors, we will ensure that there are adequate safeguards in place to protect your personal information in accordance with the UK GDPR and applicable UK Data Protection Legislation.

Your rights as a data subject

Your rights in relation to your personal information are:

  • you have a right to request access to the personal information that we hold about you by making a Subject Access Request
  • if you believe that any of your personal information is inaccurate or incomplete, you have a right to request that we correct or complete your personal information
  • you have a right to request that we restrict the processing of your personal information for specific purposes, and
  • if you wish us to delete your personal information, you may request that we do so.

Any requests received by Wheatley Group will be considered under applicable UK Data Protection Legislation. If you remain dissatisfied, you have a right to raise a complaint with the Information Commissioner's Office.
